surveyingmiddle-earth.com) hereinafter (“the Site”). By visiting or using the Site, you consent
to the data collection and use practices described in this policy. This Policy is intended to be
read with, and not to limit, other terms of use, policies and Site-related agreements.

The Site is owned and maintained by David Berberick:

The purpose of the Site is to survey and collect information from people who enjoy the works of
J.R.R. Tolkien. The Site contains a voluntary questionnaire (the “Online Questionnaire”)
soliciting  comments and/or personal information. The Online Questionnaire is located at

surveyingmiddle-earth.com/questionnaire.html.

Pursuant to a voluntary Authorization and Release Agreement, located at
www.
surveyingmiddle-earth.com/questionnaire.html, any responses and/or personal information
that you provide in the Online Questionnaire may be included in a book by David Berberick
exploring the reasons for Tolkien’s popularity (the “Book”). Such responses and personal
information may also be included in the Book’s subsidiary and derivative works, and/or in
advertising, packaging, or promotional material for the Book and its subsidiary and derivative
works, in any and all editions, versions, languages and media, now known or hereafter
discovered, in perpetuity and throughout the world.

We collect the personal information that you choose to volunteer while using the Site.

We do not knowingly collect personal information from children under the age of 18. If you
reveal that you are under 18, we will delete any information you provide.

If you do not represent to us that you have read this Privacy Policy and accepted the
Authorization and Release Agreement (the “Agreement”), we will delete any information you
provide.  However, if you provide us with your email address, we may notify you by email once,
inviting you to resubmit your responses and personal information along with representations
that you have read the Policy and accepted the Agreement.  Your original responses and
personal information will then be deleted.

If you provide us with your email address and indicate that you would like to be interviewed
and/or provide additional information, we may use your email address to contact you in order
to facilitate the collection of such additional information.

We track page views and clickstream data to compile aggregated statistics concerning use of the
Site. We may use a variety of methods for automatically collecting such “passive” information.
We are able to determine the IP address from which you access the Site.

We may sell or reveal information we collect on the Site in conjunction with publishing of the
Book and/or the disposition of David Berberick’s assets in bankruptcy. We may also disclose
information we collect on the Site to third-party service providers we retain, to provide
reports, analyses or technical support to us.

We employ security systems that we believe prevent most people from accessing your personal
information through the Site. People who try and bypass security systems, or “hackers,” are
often very skilled at breaking through security systems, though, and therefore we can make no
guarantee that your information will be 100% safe.

For your own information and protection on the Site and on the Internet in general, keep in
mind that whenever you voluntarily disclose personal information, that information can be
collected and used by others. Similarly, if you post personal information in public places, you
may receive unsolicited e-mail messages.

We reserve the right to disclose your personal information, without notice, if required to do so
by law or in the good faith belief that such action is necessary to: (a) comply with legal process
or a government request served on us; (b) protect and defend our rights or property; or (c) act
under exigent circumstances to protect the personal safety of you or a user of the Site, or the
public.

your identity before providing any such information. We reserve the right to refuse to provide
you with a copy of your personal data, but we will give reasons for any such refusal.
Appropriate reasons for refusal may include, but are not limited to: administrative burden;

This Policy applies only to the Site and not to any third-party website that may be accessed
through hyper-links on the Site. If you click on such a hyperlink, you may be taken away from
the Site to an entirely different site. It is important to note that such other sites may not follow
the same privacy policies as the Site.

We reserve the right to occasionally update this Policy. We recommend that you periodically
review this Policy.

We welcome feedback regarding this Policy. If at any time you believe that the Site has not
adhered to this Policy, please contact David Berberick and we will use commercially reasonable
